Note: Any registrant who fails to appear for a scheduled verification without good cause is considered non-compliant and may face felony charges.

Registration Law and Requirements in Eaton County

Michigan's Sex Offenders Registration Act, starting at MCL 28.721, sets the rules for registration across every Michigan county, including Eaton. MCL 28.723 requires anyone convicted of a qualifying sex offense to register with local law enforcement. This obligation starts immediately upon release from custody or, for those not incarcerated, within three business days of sentencing. People who move into Eaton County from elsewhere in Michigan or from another state must register within three business days of establishing their new address.

Under MCL 28.725, registrants must keep all of their information accurate and current. This covers home and secondary addresses, employer location, school enrollment, vehicle information, and online identifiers. Changes must be reported in person within three business days. The law does not allow a grace period beyond that. Non-compliance is treated seriously under MCL 28.729. A first failure to register or to update carries up to four years in prison and a $5,000 fine. A second violation can mean up to seven years and $10,000. Third and later violations bring up to ten years and a $10,000 fine.

Eaton County sits within the 56th Circuit Court's jurisdiction. Criminal cases arising from registration violations in the county would be prosecuted in the 56th Circuit Court in Charlotte. The district court in Charlotte handles misdemeanor and lower-level criminal matters.

Tier Classifications in Eaton County

Tier classification under MCL 28.725a determines how long a registrant stays on the Michigan sex offender registry and how often they must report. Tier I covers lower-level offenses, including fourth-degree criminal sexual conduct under MCL 750.520e. Tier I registrants stay on the list for 15 years and verify once a year. Tier II covers offenses of intermediate severity, such as second-degree criminal sexual conduct under MCL 750.520c. Tier II registrants remain on the registry for 25 years and verify every six months.

Tier III is for the most serious convictions. First-degree criminal sexual conduct under MCL 750.520b, which typically involves penetration with aggravating circumstances such as a victim under 13, use of a weapon, or causing serious personal injury, falls in Tier III. These registrants must verify every 90 days and are listed for life. The Michigan State Police assigns tier status when a person first registers based on the offense of conviction. Eaton County Sheriff's Office staff do not determine tier assignments and cannot change them. Questions about tier level must be directed to the Michigan State Police SOR Unit in Lansing.
