Michigan SORA and the Three-Tier System

Michigan's Sex Offenders Registration Act, known as SORA, is found in MCL 28.721 et seq. The law was first passed in 1994 and has been updated many times. It sets the rules for who must register, how often they must check in, and how long they stay on the list. The Michigan State Police run the registry under SORA. There are roughly 45,000 registered offenders across the state at any given time.

SORA uses a three-tier system to classify offenders based on offense type. Tier I offenders must register for 15 years and verify their address once a year during their birth month. Tier II offenders stay on the registry for 25 years and must verify twice a year. Tier III offenders face lifetime registration and must verify every three months. The tier level is set by the offense of conviction, not by a risk assessment.

Each tier covers specific offenses under Michigan law. Tier I includes fourth-degree criminal sexual conduct under MCL 750.520e when the victim is an adult. Tier II covers second-degree criminal sexual conduct under MCL 750.520c and several offenses involving children. Tier III covers the most serious offenses, including first-degree criminal sexual conduct under MCL 750.520b, which requires lifetime registration. In late 2024, a federal judge ruled some portions of SORA unconstitutional, which could affect the tier status of roughly 17,000 people statewide. Changes are still working through the courts and legislature.

Registrants must report in person within three business days if they move, change jobs, or change their school enrollment. Failure to register is a felony. A first violation can bring up to four years in prison and a $5,000 fine. Under MCL 28.728c, Tier I offenders may petition to be removed from the registry after 10 years if they meet all conditions.
