Delta County Sheriff and Local Registration

All sex offender registration in Delta County is handled by the Delta County Sheriff's Department. The office is located at 2800 College Avenue in Escanaba, MI 49829. Sheriff Todd Tardiff oversees the department and the registration process in the county.

Registrants must appear in person at the sheriff's department to complete their initial registration and all required updates. You cannot mail in a registration update or submit changes online. Each person must bring a valid government-issued photo ID, proof of their current address, and documentation about any vehicles they own or regularly use. First-time registrants also pay an initial fee of $50 at the time of registration.

The Escanaba Police Department at 1900 3rd Avenue (906-786-6810) and the Michigan State Police post in Gladstone at 922 Lakeshore Drive (906-428-4412) also work with the sheriff's department on local compliance and enforcement. If a registrant is transient or splits time between locations, each address must be reported separately.

Note: Registrants who move into Delta County from another county or another state must register with the Delta County Sheriff within three business days of establishing a local address.

Registration Requirements Under Michigan Law

Michigan's Sex Offenders Registration Act, codified beginning at MCL 28.721, applies to every county in the state, including Delta. Under MCL 28.723, any person convicted of a qualifying sex offense must register with local law enforcement. This requirement kicks in before or upon release from custody, or within three business days of moving into Michigan or changing residence.

Changes to any registered information must be reported within three business days and must be done in person at the Delta County Sheriff's Department. This covers address changes, new vehicles, changes in school enrollment, and any other details tracked by the registry under MCL 28.725. There are no exceptions to the in-person reporting requirement. Registrants who fail to comply face serious criminal penalties under MCL 28.729. A first violation carries up to four years in prison and a $5,000 fine. A second violation can mean up to seven years and $10,000. A third or subsequent violation brings up to ten years and a $10,000 fine.

The $50 annual renewal fee applies each year. There is a $550 lifetime cap on total fees paid. Most registrants pay this at the time of their annual address verification. Tier I registrants verify once a year, Tier II every six months, and Tier III every three months.

Sex Offender Tiers in Delta County

Michigan assigns every registered sex offender to one of three tiers under MCL 28.725a. The tier level determines how long someone stays on the registry and how often they must verify their information. Tier I covers lower-level offenses, including fourth-degree criminal sexual conduct under MCL 750.520e. Tier I registrants verify once each year and remain on the registry for 15 years. Tier II covers mid-range offenses such as second-degree criminal sexual conduct under MCL 750.520c. These individuals verify every six months and remain listed for 25 years.

Tier III is reserved for the most serious crimes. First-degree criminal sexual conduct under MCL 750.520b, which often involves penetration and aggravating factors like a young victim or use of force, places an offender in Tier III. These registrants must verify every 90 days and remain on the public registry for life. Tier status is assigned by the Michigan State Police based on the conviction record. The Delta County Sheriff's Office has no authority to change a tier assignment. Any questions about tier classification should go to the MSP SOR unit in Lansing.
